What it is
Workplace accident investigation is technical and documentary support for a company after an on-site injury: correctly recording the circumstances, classifying the event, preparing N-1 reports, and defending the employer's interests before the State Labour Service (Derzhpratsi) commission. Put simply, we are by your side from the very first hour to help, not to punish — and to keep the wording in the documents from turning into a fine or a criminal case.
When companies come to us
Companies come to us when an accident has happened and a response is needed immediately: a minor or severe injury on site, a group or fatal accident, a situation where the State Labour Service has already sent an inspector, or when a report needs to be challenged. Every hour affects the quality of the record, and the first statements and reports are later almost impossible to change. For a production manager this service is critical: they are personally liable for the consequences of an accident — up to criminal liability under Article 271-272 of Ukraine's Criminal Code. And HR should not have to figure out the procedure alone — we run it from the first hour.

06ACCIDENT CLASSIFICATION

The N-1 report and classification — 7 scenarios, and what each one means

Correct accident classification is the foundation of everything. Below are the typical scenarios we've seen over 18 years, with an example of wording and a forecast of the next steps.

Illustration — a hard hat, accident classification

The key point: the wording in the first documents — the investigation report, witness statements — is later almost impossible to change. It is the input data for all subsequent decisions. The earlier an occupational safety engineer is involved, the cleaner that wording is.

An off-duty injury on company premises
Example: an employee falls in an office corridor during the lunch break. The commission still investigates the event, but may classify it as not work-related — this is recorded in the relevant section of the N-1 report, and there are no payments as for a workplace injury from the Pension Fund (only ordinary sick leave). It is important to record the time and circumstances correctly.
A minor workplace accident
Example: someone cut themselves in a restaurant kitchen. An N-1 report, classified "minor". Investigation by the company commission — 5 working days, a payment from the Pension Fund, no criminal consequences. But formally an OHS instruction was breached — it needs updating.
A severe workplace accident
Example: an employee fell from height without fall-protection equipment. A special investigation is carried out — 15 working days (may be extended), with the involvement of the State Labour Service. Risk of a criminal case under Article 271 of Ukraine's Criminal Code — up to 7 years' imprisonment for the employer's official.
A fatal accident
A special investigation — 15 working days, possibly extended. Mandatory participation of the police, the prosecutor's office, the State Labour Service, the trade union, the Pension Fund. Criminal proceedings under Article 271-272 of Ukraine's Criminal Code. An independent OHS assessment and flawless documents are required (we recommend engaging your own attorney — we provide the technical and documentary part).
A group accident (2+ injured)
Subject to a special investigation. For the employer this is not only a reputational blow but also the risk of a decision to halt work until the violations are remedied.
An accident caused by the employee (safety breach)
The offender had been instructed, there are signatures in the logs and valid certificates — this directly affects the commission's conclusions and the extent of the employer's liability. It is critical to prove that training and instruction took place.
An accident with a breach of conduct (alcohol, drugs)
A medical opinion on the injured person's state of intoxication is required. If intoxication is confirmed — this affects the classification and the compensation from the Pension Fund. Without a timely opinion — there is a risk of classification in the injured person's favour.
