Labour safety (MTB) declaration —turnkey

A declaration of compliance of the material and technical base (MTB) with occupational safety legislation is a document by which an employer confirms that its base is sufficient to perform high-risk work and operate high-risk equipment safely. It is registered with the State Labour Service (Derzhpratsi) via Diia under the Procedure approved by Cabinet of Ministers Resolution No. 1107. We will check your material and technical base, prepare the documents and register the declaration. For fire safety there is a separate SES declaration.

Declaration of Conformity MTB

  • What it is

    A declaration of compliance of the MTB (material and technical base) with occupational safety legislation is a document submitted to the State Labour Service (Derzhpratsi) before high-risk work begins or high-risk machinery and equipment is put into operation. The procedure is set by Cabinet of Ministers Resolution No. 1107. The declaration is registered free of charge, including online via Diia. We will help you determine whether you need a declaration rather than a permit, and prepare everything for registration.

  • When to order

    Most often clients come to us when a company launches new work at height, welding or machine-shop production; buys or commissions a crane, forklift, lift or pressure vessel; or changes the work site or equipment and is not sure which declaration to file. For the manager, the key is not to start work without the required document and not to get an order or a work stoppage; for HR, not to work through the lists and work groups alone.

  • How we work

    We follow the Racio Safety Standard approach — only what is needed, nothing extra. An engineer remotely audits your MTB: checks work and equipment against the lists, determines the group and verifies what is missing for registration. In the SMART and FULL packages we also develop documentation and organize training and certification at a specialized training center — we do not conduct the training ourselves. An example from practice is the case on permit documentation for equipment: the crane and forklifts were registered, and a permit was obtained for the crane.

Whether your company needs a declaration or a permit depends on the lists of work and equipment and on whether martial law is in effect. We will check against your list.

  • What is an MTB declaration?

    It is a declaration of compliance of the material and technical base with occupational safety legislation. It is submitted to the State Labour Service (Derzhpratsi) before high-risk work begins or the relevant equipment is put into operation. The procedure is set by Cabinet of Ministers Resolution No. 1107.

  • Are the MTB declaration and the SES declaration the same thing?

    No. The MTB declaration concerns occupational safety and is submitted to the State Labour Service. The State Emergency Service (SES) declaration is about fire safety. For the fire declaration, see the SES declaration.

  • Who submits the declaration and how?

    The declaration is submitted by a sole proprietor (FOP) or the head of a legal entity with an electronic signature — online via Diia (free of charge), through an administrative services center (CNAP) or by mail. We prepare the data, check the names of work and equipment against the lists and organize registration via Diia.

  • What are the filing deadlines?

    No later than 5 working days before work begins. The territorial office of the State Labour Service registers it within 5 working days, and registration is free of charge. Documents are returned without review if fields are not filled in or the work is not covered by the declaration requirement.

  • How long is an MTB declaration valid?

    A declaration is not filed once and for all: if the work, equipment or location changes, an updated one is submitted within 7 working days after the changes. We will tell you what exactly needs updating in your case during the consultation.

  • Declaration or permit — what does my company need?

    It depends on the list of work and equipment: for group B a declaration is enough, for group A a permit is required. During martial law, most group A items are performed under a declaration (Cabinet of Ministers Resolution No. 357), but some work, including gas-hazardous work, remains subject to a permit. Details are in our article on Resolution 1107.

  • Is a declaration needed for a diesel generator or other specific equipment?

    It depends on whether the equipment is on the list of high-risk machinery and equipment. We will check everything against your list during the consultation.

  • How much does an MTB declaration cost?

    START — 15,860 ₴ (remote MTB audit and registration via Diia, from 5 working days), SMART — 25,860 ₴ (plus documentation and organization of training), FULL — from 35,860 ₴ (full development of documentation, organization of training, registration).   • Do you conduct the training yourselves?

    No. RACIO does not conduct training: we organize it and the issuance of certificates at a specialized training center. This is included in the SMART and FULL packages.
